Article 10 of Law 34/2002, 11 July, on information society services and electronic commerce states that the provider of information society services is obliged to provide means that allow both the receivers of the service and the relevant authorities to access the following information by electronic means, permanently, easily, directly and free:

CONDITIONS FOR USE
Ambit, purpose and scope
These conditions (the "CONDITIONS FOR USE" from now on) regulate the access to and use of the Web site service that ZAYER makes available to Internet users (the "USER(S)" from now on) through the domain www.zayer.com/es (the "WEB SITE" from now on).
Without prejudice to the above, the access to certain contents and the use of some of the services that ZAYER makes available to the USER through the WEB SITE may be subject to certain special conditions (the "SPECIAL CONDITIONS" from now on) which, as relevant, will replace, complete and/or modify these CONDITIONS FOR USE and which, in the event of contradiction, will prevail over them. When applicable, these SPECIAL CONDITIONS will be made available to the USERS.
As a consequence, before accessing these contents and/or using these services, the USER must know and, as relevant, accept, the SPECIAL CONDITIONS that regulate them.
ZAYER reserves the facility to make any modification or update to the contents of these CONDITIONS FOR USE as well as, as relevant, to the relevant SPECIAL CONDITIONS and, generally, to any elements in the design and configuration of the WEB SITE at any time and without the need for prior notification.
The CONDITIONS FOR USE published in the latest update of the WEB SITE will apply and those published on the WEB SITE at the time will apply in each visit.
By accessing the WEB SITE, the USER consents and accepts, specifically and without reservations, these CONDITIONS FOR USE in virtue of which the form of using it is determined, this acceptance having the same validity as any other written and signed contract. If the USER does not fully accept these CONDITIONS FOR USE, he or she will not be authorised to access the WEB SITE.
Registration of USER and password
When the use of the WEB SITE and/or the access to certain contents and/or services made available to his or her by ZAYER through it requires the registration of the USER, the latter will be responsible for providing true and legal information for the purpose.
In this registration, which will occur in the form provided for the purpose by ZAYER at any time, the USER will be allocated (i) a login name and (ii) a password, which will allow the USER to start the session at any time as a registered user of the WEB SITE.
The USER is obliged to use the allocated login name and password diligently and will be responsible for their suitable safekeeping and confidentiality, undertaking not to cede their use to third parties, whether temporarily or permanently and not to allow access by unauthorised persons.
In the event of the theft or loss of or unauthorised access using a login name and password, the USER will be responsible for immediately reporting this circumstance to ZAYER so that it can cancel them. In no case will ZAYER be responsible for the actions of unauthorised third parties that use the USER’s login name and password before this notification is received from the USER.
Financial conditions for access to and use of the WEB SITE
Unless, as relevant, the SPECIAL CONDITIONS state otherwise, access to the WEB SITE and to its contents is free, except for the cost of the connection to the telecommunications system contracted by the USER with a provider.
Industrial and intellectual property rights
All the industrial and intellectual property rights over the WEB SITE are legally reserved and the access to and use of them by the USER must not in any way be considered as the granting of any licence for use or right over any asset owned by ZAYER and/or any third parties. This reservation or rights covers both (i) the look and feel and the code, design and browsing structure of the WEB SITE as well as (ii) the contents that may be included in and distributed through the WEB SITE in any form and, especially, any catalogues, technical data, drawings, schematics and designs, whether or not graphical, that ZAYER includes on the WEB SITE.
The inclusion on the WEB SITE of references to commercial names, brands, logotypes or other distinctive signs, whether or not registered, whether owned by ZAYER or by third parties, is subject to the prohibition of their use without the specific consent of ZAYER or of their legitimate owner.
As a consequence, the USER may only display and use the contents and services made available through the WEB SITE for strictly personal and private means and as long as this is not with the purpose of developing commercial or professional actions with these contents and/or services.
It is also forbidden to de-compile, dis-assemble, reverse engineer, sub-licence or transmit in any way, translate or undertake works derived from the computer programs necessary for the functioning of, access to and use of the WEB SITE. The USER must in all cases abstain from deleting, altering, evading or manipulating any protection device or security system that may be installed on the WEB SITE.
Responsibility and guarantees
Those using the WEB SITE do so at their own risk. By accessing the WEB SITE, the USER is obliged to (i) not indulge in any conduct that may damage the image, interests and rights of ZAYER or of third parties or that may damage, disable or overload the WEB SITE or that in any way impedes its normal use and (ii) use it in a manner fully in accordance with the laws and uses of the traffic.
As a consequence, the USER will be liable to ZAYER and/or to third parties for any damages and prejudices that may be caused as a consequence of failing to comply with these obligations.
ZAYER adopts the security measures it considers pertinent to maintain the proper functioning of the WEB SITE and to detect the existence of viruses and harmful components. Despite this, the USER must be aware that the security measures in computer systems on the Internet are not entirely reliable and therefore ZAYER cannot guarantee (i) the continuous availability of the contents and services on the WEB SITE, (ii) the absence of errors in these contents nor the correction of any error that may occur, (iii) the non-existence of viruses or other harmful elements that could cause alterations in the USER’s computer systems (software and hardware) or in its electronic documents and files contained in them, nor (iv) the infallibility of the security measures adopted.
Likewise, ZAYER reserves the right to partially or totally interrupt the service, temporarily or permanently, for technical changes or faults, communicating it beforehand if possible through the WEB SITE or through any other means provided for the purpose.
Through the WEB SITE, ZAYER provides the USER with technical linking devices (such as buttons, links and banners) that may lead the USER to other Internet sites or portals belonging to or managed by third parties and over which ZAYER has no type of control (“LINKED SITES” from now on).
When using these linking devices and accessing the LINKED SITES from the WEB SITE, the USER must remember that these CONDITIONS FOR USE cease to be applicable.
ZAYER neither knows or controls in any way the contents and services in the LINKED SITES and the inclusion of an access to them through the WEB SITE in no case implies (i) that ZAYER recommends or approves the contents and services housed on the LINKED SITES and/or (ii) that there is any type of relationship, collaboration or dependency between ZAYER and those responsible for the LINKED SITE.
As a consequence, ZAYER accepts no type of liability relating to the LINKED SITES and, therefore, does not respond for their functioning, the contents and services housed on them nor for the links on these LINKED SITES.
If the USER has effective knowledge of the illegality or unsuitability of the contents, services or any other activities undertaken through a LINKED SITE, he or she must report it immediately to ZAYER so that, as relevant, the measures considered appropriate can be taken.
The setting up of hypertext links (hyperlinks) on other Web sites or pages is authorised, as long as they point to the home page www.zayer.com/es, or, as relevant, to any other internal page (deep link) on the WEB SITE and that the relevant pages appear in a full window and under their respective URLs, assuming their total responsibility and risk that may arise from setting up the hyperlink to the WEB SITE.
The Web site or page that sets up the hyperlink may not declare in any way that ZAYER has authorised the hyperlink unless ZAYER had done so specifically and in writing.
If the third party that sets up the hyperlink on its Web site or page wishes to include the brand, name, commercial name, sign, logotype or any other identification element owned by ZAYER and/or referring to the WEB SITE it must have the prior, specific and written authorisation of ZAYER for this.
Without prejudice to all of the above, it is specifically forbidden to display a page of the http://www.zayer.com/es/ Web site in a window on another Web site that does not belong to ZAYER using the technique called “framing” without the specific consent of ZAYER.
Likewise, it is specifically forbidden to insert any type of contents published via http://www.zayer.com/es/ in another Web site or page other than the WEB SITE using the technique of “in-line linking” without the specific consent of ZAYER.
The setting up of a hyperlink in the above conditions will not in any case imply the existence of relationships between ZAYER and the owner of/person responsible for the Web site or page on which that hyperlink is established, nor the acceptance or approval by ZAYER of its contents and/or services.
In all cases, ZAYER reserves the right to forbid or disable any hyperlink to the WEB SITE, especially in cases of illegal activity and/or contents on the Web site or page on which it is included.
Right of information
In accordance with Organic Law 15/1999, 13 December, on the protection of personal data, the USER is informed of the existence of personal data files for which ZAYER is responsible, created for the purposes described below and that have been registered in the Spanish Data Protection Agency.
ZAYER does not use "Spaming" techniques and apart from the contents of the "Política de cookies" section, neither are USERS recorded by merely visiting the WEB SITE. ZAYER will process only the information that the USER provides through registration, when this is required, by e-mail and/or on being informed of the services offered by ZAYER through the WEB SITE.
Purpose of the data processing
The purposes of the collection and processing of the data that any person requesting information or USER provides to ZAYER via the WEB SITE and/or by e-mail are (i) to maintain and manage the relationship with the USER, (ii) manage access and use by the USER of the contents and services that ZAYER makes available to him or her via the WEB SITE, (iii) manage the contracting and provision of services to the USER by ZAYER and (iv) manage requests made by USERS and provide the relevant information relating to the consultations made.
Registration as a USER for access to the contents and services offered by ZAYER via the WEB SITE, when required, as well as the provision of data with the forms available on the WEB SITE and/or the sending of a consultation e-mail, imply the consent of the USER or requester of information to the processing of the data in these means of communication.
The provision of information required on personal data in those fields marked with an asterisk (*) on the forms available on the WEB SITE will be obligatory. The failure to fill in these obligatory fields or the provision of incorrect data will make it impossible for ZAYER to manage the USER’s request, send the requested information or provide the required services.
This being the case, (i) through the registration procedure, when possible and/or (ii) by supplying information via the forms available on the WEB SITE and clicking on the “Send” button (or equivalent) in these forms, the USER declares that the information and data provided are exact and true.
Any modification that may be made to the personal data must be communicated by their owner to the person responsible for the file, being responsible in any case for the truth and exactness of the data supplied at all times.
If data of third parties are supplied, the USER declares that he or she has the specific consent of their owner for this communication of data.
USERS are informed that they may oppose the processing of their data for purposes other than those described above. For this purpose, without prejudice to the specific and informed consent that, as relevant, the USER provides with the registration, it will be understood that the USER consents to the set of purposes described above if he or she shows no opposition within 30 calendar days from the collection of the data.
Rights of access, correction, cancellation and objection
USERS may exercise their rights of access, correction, cancellation and objection to the processing of their personal data in the terms and conditions described in Organic Law 15/1999, 13 December, on the protection of personal data, with a request sent in writing to the attention of the person responsible for the file in the terms of current legislation to the following address: ZAYER, SA, Polígono Industrial Betoño, Portal de Bergara 7, 01013 Vitoria-Gasteiz (Álava).
Ceding of data
The data provided by the USER will not be ceded to third parties except in those cases in which, on being collected, this ceding is specifically indicated and consented to by the USER.
Confidentiality and security
ZAYER guarantees the confidentiality of the personal data provided by the USER and its processing in accordance with current personal data legislation, undertaking to keep them secret.
Likewise, the USER is informed that ZAYER maintains the security levels for protecting data in accordance with Royal Decree 1720/2007, 21 December, approving the regulations arising from Organic Law 15/1999, 13 December, on the protection of personal data and has set up all the technical means available to it to prevent the loss, misuse, alteration, unauthorised access and/or theft of the data that the USER provides to ZAYER, without prejudice to informing USERS that the security measures on the Internet are not impregnable.

APPLICABLE LEGISLATION AND JURISDICTION
These CONDITIONS FOR USE are subject to the Spanish legal system.
For the resolution of any conflict that may arise from access to the WEB SITE, its contents and/or the services that ZAYER makes available to the USER via the WEB SITE, the USER and ZAYER agree to submit themselves specifically to the law courts of Vitoria-Gasteiz, renouncing any other general or special forum that may correspond to them.
